Memorandum of Agreement with the Competition Commission to address issues of concurrent jurisdictions (concurrent authority)

Pretoria – The Independent Communications Authority of South Africa and Competition Commission will sign a Memorandum of Agreement (MoA) that will address issues of concurrent jurisdictions (concurrent authority) between the two institutions today.

ICASA’s acting Chairperson, Dr. Keabetswe Modimoeng, and the Competition Commissioner, Tembinkosi Bonakele, will sign the document which is aimed at establishing a formal relationship between the two organisation and be able to collaboratively handle areas of co-jurisdiction seamlessly.

Further, the agreement will, amongst other things, help effectively coordinate decision making and consultations with regards to definition of markets for electronic communications, broadcasting and postal services and determining whether or not there is effective competition in these markets. It will also cover undertaking enquiries on dominance or significant market power in such markets.

The signing of ceremony will take place on the sidelines of the 13th Annual Competition Law, Economics and Policy Conference held at 012 Central at 15:00.

Dr. Keabetswe Modimoeng says the signing of the MoA will further promote information sharing and research between the two entities on matters of mutual interest in the realm of competition legislation and regulation; and also promote awareness of the role of ICASA and the Commission as well as foster collaboration between the two entities.

“The MoA is an important milestone between the Commission and the Authority in establishing and formalising our relationship on the uniform enforcement of competition legislation”, says Dr. Modimoeng.
